Tell Us Everything - Promotion Terms & Conditions
1. Promoter
This promotion is operated by Brothers Drinks Co. Ltd (“Brothers”, “we”, “us”, “our”).
2. Eligibility
The promotion is open to residents of the United Kingdom aged 18 years or over only.
The promotion is not open to:
- employees, officers or representatives of Brothers Drinks Co. Ltd;
- any agencies, suppliers or third parties professionally connected with the administration of the promotion; or
- members of the immediate families or households of any of the above.
By entering, you confirm that you are eligible to do so and that all information submitted by you is true and accurate.
3. Promotion period
The promotion opens on [START DATE] and closes at 11:59pm on [END DATE].
Entries received by 11:59pm on the last day of each calendar month will be considered in that month’s selection.
4. How to enter
To enter, participants must:
- access the Brothers “Tell Us Everything” page via QR code or direct link;
- complete the required fields on the entry form;
- submit a festival, event or night-out memory in the text field;
- optionally upload a photo or video; and
- accept the required Promotion Terms and Privacy Notice checkbox.
No purchase is necessary unless expressly stated otherwise in the relevant promotional materials.
Only one entry per person per memory/story should be submitted. Brothers reserves the right to remove duplicate, automated, bulk or fraudulent entries.
5. Entry requirements
Entries must be lawful, truthful and genuinely submitted by the entrant.
By submitting an entry, you confirm that:
- the story is your own original account, or you otherwise have the right to submit it;
- any photo, video or other material uploaded is owned by you or submitted with the permission of the relevant rights holder;
- the content does not infringe the intellectual property, privacy, publicity or other rights of any third party;
- the content does not contain anything defamatory, obscene, sexually explicit, hateful, discriminatory, threatening, abusive, misleading, unlawful or otherwise inappropriate.
- where any person is identifiable in an uploaded photo or video, you have their permission to submit that content to Brothers for the purposes set out in these Terms; and
- all identifiable individuals shown in submitted content are aged 18 or over.
Brothers reserves the right to reject, remove or disqualify any entry that it considers, in its reasonable opinion, to be in breach of these Terms or otherwise unsuitable.
6. Monthly selection and prizes
At the end of each month during the promotion period, Brothers will select its favourite valid entries. The number of winners selected each month will be [INSERT NUMBER].
Prizes may include Brothers stock, merchandise, vouchers, event-related rewards, or other items selected by Brothers. Prize details may vary from month to month.
Alcohol prizes will only be awarded where the recipient is verified as being aged 18 or over.
Prizes are subject to availability. Brothers reserves the right to substitute a prize with another of equal or greater value where necessary.
Prizes are non-transferable, non-refundable and, unless otherwise stated, no cash alternative will be offered.
7. Winner selection process
This is a judged promotion, not a random draw.
Winners will be selected by Brothers based on entries deemed the most memorable, entertaining, original, warm, surprising or otherwise in keeping with the spirit of the campaign.
The decision of Brothers is final, and no correspondence will be entered into regarding the outcome.
8. Winner notification
Winners will be contacted using the email address provided on entry within 7 days of selection. If a selected winner does not respond within 7 days of first contact, or is found to be ineligible, Brothers reserves the right to withdraw the prize and select an alternative winner.
Brothers will make reasonable efforts to contact winners, in line with ASA expectations for prize promotions.
9. Delivery of prizes
Where a physical prize is awarded, winners may be required to provide a UK delivery address. Prizes should usually be fulfilled within 28 days of winner confirmation, unless otherwise stated.
Brothers is not responsible for delays caused by incomplete address details, courier disruption, events outside its control, or the winner’s failure to respond promptly.
10. Publicity
Brothers may ask winners to take part in reasonable publicity relating to the promotion.
Brothers will not publish personal information beyond what is permitted by applicable law, these Terms, and the permissions granted by the entrant.
11. Permission to use submitted content
If you tick the content permission checkbox at the point of entry, you grant Brothers a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to use, reproduce, publish, display, communicate, distribute, edit, adapt, crop, resize and otherwise reproduce your submitted story, name, social handle and any uploaded photo/video in connection with Brothers marketing and promotional activity.
This may include use across:
- social media;
- websites;
- emails;
- paid advertising;
- point of sale;
- PR materials;
- printed materials;
- event materials; and
- other Brothers-owned or controlled channels.
Brothers may make light edits for formatting, layout, spelling, grammar, length, captioning, accessibility, moderation or brand-safety purposes, provided the overall meaning of your submission is not materially misrepresented.
You understand that:
- Brothers is not obliged to use any submission;
- Brothers may stop using a submission at any time;
- Brothers may already have similar ideas, campaigns or content in development; and
- once content has been published, scheduled, printed, syndicated or shared with media/platform partners, Brothers may not be able to fully withdraw or recall it.
12. Withdrawal of content permission
If you have granted content-use permission and later want Brothers to stop using your content in future materials, you may contact info@brothersdrinks.co.uk.
Brothers will, within a reasonable period, stop any new or future use of your content where reasonably practicable. However, Brothers may not be able to retrieve or erase content already:
- printed;
- published;
- reposted by third parties;
- included in press materials;
- scheduled in campaigns already in production; or
- archived where retention is required for legal or administrative reasons.
This is a sensible operational protection because consent withdrawal can affect future use, but not always material already out in the world. The ICO stresses that consent must be withdrawable, but real-world limitations should be explained clearly.
13. Marketing consent
If you choose to opt in to receive marketing communications from Brothers, Brothers may send you news, launches, events, offers and other marketing by email.
Marketing consent is optional and is not required to enter the promotion.
You can withdraw your marketing consent at any time by using the unsubscribe link in marketing emails or by contacting Brothers.
This separation is important under ICO/PECR guidance.
14. Privacy and personal data
Brothers will process personal data submitted in connection with this promotion in accordance with its Privacy Policy and applicable data protection law.
Depending on how the campaign is structured internally, Brothers is likely to process personal data for purposes including:
- administering the promotion;
- verifying eligibility;
- contacting entrants and winners;
- moderating entries;
- fulfilling prizes;
- managing permissions and rights attached to submitted content;
- handling complaints or disputes;
- complying with legal and regulatory obligations; and
- sending marketing, where the entrant has separately opted in.
The categories of personal data processed may include:
- name;
- email address;
- age confirmation / age group;
- submitted story text;
- uploaded photos and videos;
- delivery address, if required for prize fulfilment; and
- technical data connected with website use.
Entrants should read the Brothers Privacy Policy (LINK) and the campaign-specific privacy wording presented at the point of entry.
15. Disqualification and moderation
Brothers reserves the right to disqualify entries that:
- are incomplete, illegible or technically corrupted;
- are submitted by bots, scripts or automated means;
- are suspected to be fraudulent;
- contain inappropriate or unlawful material; or
- otherwise breach these Terms.
Brothers may also suspend or refuse entry where it reasonably suspects abuse of the promotion.
16. Limitation of liability
So far as permitted by law, Brothers accepts no responsibility for:
- lost, delayed, corrupted or incomplete entries;
- technical malfunctions of networks, servers, websites or devices;
- incompatibility of files uploaded by entrants;
- delivery failures outside Brothers’ reasonable control; or
- any indirect or consequential loss arising from participation in the promotion.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.
17. Changes, suspension or cancellation
Brothers reserves the right to amend, suspend or cancel the promotion where necessary due to circumstances beyond its reasonable control, or where required to ensure the promotion is administered fairly and lawfully.
Any material changes will be posted on the promotion page or otherwise clearly communicated.
18. Winner information
If required by applicable law or self-regulatory rules, Brothers may make available limited winner information in accordance with those requirements.
19. Governing law
These Terms are governed by the laws of England and Wales. Any disputes arising in connection with these Terms or the promotion shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless consumer law in another part of the UK requires otherwise.
